GLOBAL HEALING: LIVE HEALTHY™ REWARDS PROGRAM
TERMS AND CONDITIONS
The Program is open to any person with a valid address who is age 18 or older. There is no fee to join or to maintain membership.
When you create an account at checkout on the GlobalHealing.com website you will automatically be enrolled in the Program. If you would like to create an account separately from a purchase you may do so online at https://globalhealing.com/account/login or by phone at 1-800-476-0016. During the course of your membership you may update your personal information by logging in to your online account. Members are solely responsible for keeping their profile information current.
Each Member is permitted only one Live Healthy™ Rewards program membership, and neither memberships nor rewards are transferable. Employees of Global Healing and its subsidiaries, Wholesale accounts and anyone else receiving employee-based discounts are ineligible for membership in the Program.
LIVE HEALTHY™REWARDS PROGRAM BENEFITS
Each time you log in to your account and make purchases on GlobalHealing.com you will earn reward points based on dollars spent, excluding Shipping and Taxes. You must be logged in to your account prior to checkout in order to earn points. Points will not be applied to orders placed before 7/15/2020. Other exclusions may apply. Please allow up to 48 hours for your points to appear on your Account page.
Birthday Rewards Points will be granted to Members who have their birth month selected in their account profile prior to that birth month, who remain enrolled to receive e-mail and direct mail marketing communications, and who have shopped with us during the past 12 months.
Points may be used to acquire certain Program Benefits. Points and Benefits will change from time to time and some may be offered on a limited basis. Any rewards and benefits offered under the Program are subject to change at any time at our sole discretion. You can view the current Benefits as well as our FAQ's on the Live Healthy™ Rewards Program page of GlobalHealing.com. Global Healing is not responsible for Program benefits that are not received as a result of loss or if you don’t maintain accurate personal information with us, and such Benefits will not be reissued.
Program rewards have no cash value, cannot be sold and are non-transferable. Only the Program Member who is paying for the Qualifying Purchase may accumulate rewards and benefits and only the Program Member may redeem rewards that have accumulated in that Member's account. The sale, barter, transfer or assignment of any reward or benefit offered through the Program, other than by Global Healing, is expressly prohibited and will be cause for termination of your participation in the Program.
You cannot combine multiple rewards in a single order. It's possible your code might not be valid if you have a free product in your cart. You can always use the discount code for a future order. Head to your rewards account and check your Rewards History if you need help finding the discount code. Rewards discounts cannot be combined with other discount codes.
Live Healthy Rewards Members can earn additional benefits by participating in Share the Health, Global Healing’s refer-a-friend program. Send qualified Friends a link that will entitle them to $10 off their full price merchandise purchase of $50 or more on GlobalHealing.com. When your friend activates the coupon, you will receive a coupon for $10 off your own purchase of $50 or more!
To qualify for a referral, your Friend must be 18 years of age or older and must have a valid address. They must also be a new customer to Global Healing, meaning that they have not purchased from our site at any time in the past.
To participate, log in to your account at GlobalHealing.com and follow the instructions to submit referrals by entering their names and email addresses in the Refer-a-Friend box. Each qualified Friend you enter will then receive an emailed invitation with instructions on how to redeem their offer. You may refer as many Friends as you like and receive as many referral rewards as you qualify for.
Members who enroll in the Live Healthy Rewards Program agree to receive Program-specific marketing and status updates as well as other promotional emails and marketing from Global Healing. In order to receive the full Program benefits, you must remain opted-in to our general marketing and Program marketing communications and our Program-specific marketing communications via e-mail and direct mail at all times. If you elect to opt-out of e-mail or direct mail marketing communications, your Membership will remain active, but you can miss out on time sensitive exclusive offers and won't be able to use them retroactively.
To stop receiving promotional emails from Global Healing, you may use the unsubscribe option in any such email, or go to the My Account page to update your communications preferences. By unsubscribing, you are only opting out of marketing communications; we may still communicate with you regarding your Program status or transactions or your other transactions with us.
In the event that we introduce a text-messaging program for our brand at any time, by including your mobile number in your profile you are agreeing to subscribe to Global Healing Mobile Alerts to receive up to 5 text messages per month. Standard text messaging rates apply. To unsubscribe at any time, reply with STOP to any text received from us.
PROGRAM TERMINATION, CANCELLATION OR MODIFICATION
This Agreement shall be interpreted and applied to give Global Healing maximum control of the administration of the Program. All decisions by Global Healing are final and binding.
Global Healing reserves the right to change or modify the Program, its Benefits or this Agreement from time to time in its sole discretion and without any further obligation to our Members. Updates shall be effective on the date they are posted on https://globalhealing.com/pages/live-healthy-rewards-program, and you agree that such posting constitutes valid and effective notification method and no further notice methods are required; continued use of your Membership after such date constitutes acceptance of all such changes. We may also, as a courtesy only, send updates via e-mail or notify you that there are updates the next time you make a purchase at a Participating Location; doing so does not create any obligation on our part to do so again in the future. If you disagree with any changes, your sole remedy is to cancel your Membership in the Live Healthy™ Rewards Program.
If you decide that you no longer want to participate in the Program, you may cancel your membership at any time by contacting our customer service team at 1-800-476-0016, Monday to Friday , between the hours of 10:00 AM to 6:00 PM Central Time.
4.5 Global Healing may terminate this Program or limit participation, each in whole, or in part, in our sole discretion, at any time without notice. If the Program is terminated or so modified, all accrued Rewards or offers in any affected account(s) will be available for use through their individual expiration dates, in accordance with the terms of this Agreement and their individual terms.
5.1 NO TRANSFER. Live Healthy™ Rewards benefits may not be transferred, purchased, sold, assigned, auctioned or traded, including, without limitation, by death or as part of a domestic relations matter. Doing so will void the Member account. Benefits have no cash value and are not redeemable for cash. Member agrees that the Program and any Benefits related thereto do not create any property rights whatsoever in favor of the Member.
5.2 RESALE POLICY. Products offered by Global Healing are not offered for resale; by signing up for the Live Healthy™ Rewards Program, you expressly acknowledge and agree that you are entering an agreement with Global Healing that you will not offer for sale, sell, transship or otherwise engage in any commercial activity (or permit any third parties acting on your behalf to do so) in relation to any products purchased from us using your Rewards account (or otherwise); if you are suspected of breaching this provision, in addition to immediately suspending your Membership and shopping privileges with Global Healing, you agree that Global Healing may pursue all legal and equitable remedies available against you or anyone acting on your behalf for such breach of contract, including but not limited to, monetary damages, injunctions and/or other remedies. Additionally, we may place limits on purchases and reject purchases or orders suspected of consisting of commercial quantities of our products or that otherwise violate the spirit of this section. We may, among other things, restrict orders placed by or under the same customer account, the same credit card, Rewards program account, and/or orders that use the same billing and/or shipping address, including orders or related accounts on our Affiliates’ websites.
5.3 We also reserve the right to cancel any portion of an order that cannot be fulfilled for any reason. Online orders are not deemed to be accepted by Global Healing until your products are shipped from our warehouse; however an acceptance of an order by Global Healing does not constitute a waiver of our rights under our resale policy. We reserve the right to limit, cancel or prohibit orders that, in our judgment, appear to be placed in violation of this policy and the right to cease doing business with customers who violate this policy. This policy applies to all purchases of Global Healing products. We may modify this policy at any time without prior notice.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
Your consent and agreement to the following disclaimers and limitations is a material inducement for us to permit you to participate in the Program. To the fullest extent permitted by applicable law, your participation in the Program, and our obligations and liabilities in respect thereto, is expressly limited as follows:
7.1. EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS, YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE PROGRAM AND ANY REWARDS OR BENEFITS ASSOCIATED THEREWITH ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY WHATSOVER. TO THE FULLEST EXTENT PERMITTED BY LAW AND EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS, NEITHER GLOBAL HEALING NOR ITS SUBSIDIARIES, AFFILIATES, PARTNERS OR LICENSORS MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THESE TERMS OR THE PROGRAM OR ANY OF THE REWARDS OR BENEFITS ASSOCIATED WITH THE PROGRAM, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
7.2. YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER GLOBAL HEALING NOR ITS SUBSIDIARIES, AFFILIATES, PARTNERS OR LICENSORS WILL BE RESPONSIBLE OR LIABLE (WHETHER IN CONTRACT, TORT OR OTHERWISE) UNDER ANY CIRCUMSTANCES FOR ANY: (A) ERRORS, MISTAKES, INACCURACIES OR OMISSIONS IN THE CONTENT OF THESE TERMS, THE PROGRAM AND/OR ANY REWARDS OR BENEFITS ASSOCIATED WITH THE PROGRAM; (B) PERSONAL INJURY, PROPERTY DAMAGE OR LOSS, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR PARTICIPATION IN THE PROGRAM AND/OR YOUR REDEMPTION OR USE OF ANY REWARD OR BENEFIT UNDER THE PROGRAM; (C) INTERRUPTION OF BUSINESS; (D) DELAYS OR INTERRUPTION IN ACCESS TO THE PROGRAM; (E) ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVERS THAT HOST THIS SITE OR ANY THIRD PARTY SITE(S) AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (F) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THIS SITE OR THIRD PARTY SITE(S), (G) ANY BUGS, VIRUSES, TROJAN HORSES OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE GLOBAL HEALING SITE OR ANY THIRD PARTY SITE(S) ASSOCIATED WITH THE PROGRAM AND/OR ANY REWARDS OR BENEFITS ASSOCIATED THEREWITH; (H) DATA NON-DELIVERY, LOSS, THEFT, MISDIRECTION, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; OR (I) EVENTS BEYOND OUR REASONABLE CONTROL.
7.3. YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER GLOBAL HEALING NOR ITS SUBSIDIARIES, AFFILIATES, PARTNERS OR LICENSORS WILL BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) RELATED TO THE PROGRAM AND/OR YOUR PARTICIPATION IN THE PROGRAM AND/OR YOUR REDEMPTION OR USE OF ANY PROGRAM REWARD OR BENEFIT, REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00).
7.4. YOU AGREE THAT NO CLAIMS OR CAUSES OF ACTION ARISING OUT OF, OR RELATED TO, THESE TERMS, YOUR PARTICIPATION IN THE PROGRAM AND/OR YOUR REDEMPTION OR USE OF ANY REWARD OR BENEFIT UNDER THE PROGRAM, MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE. TO THE EXTENT PERMITTED BY LAW, IF YOU HAVE A DISPUTE WITH US REGARDING THE PROGRAM OR ARE DISSATISFIED WITH THE PROGRAM, YOUR SOLE REMEDY SHALL BE TERMINATION OF YOUR MEMBERSHIP IN THE PROGRAM AND WE SHALL HAVE NO OTHER OBLIGATION, LIABILITY OR RESPONSIBILITY TO YOU.
8.1 YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS GLOBAL HEALING, ITS SUBSIDIARIES, AFFILIATES, PARTNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, VENDORS, MANUFACTURERS AND DISTRIBUTORS FROM AND AGAINST ANY AND ALL THIRD PARTY CLAIMS, ACTIONS, DEMANDS, CHARGES, COMPLAINTS, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS' FEES), ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM AND/OR YOUR REDEMPTION OR USE OF ANY REWARDS OR BENEFITS ASSOCIATED WITH THE PROGRAM AND/OR YOUR BREACH OF ANY OF THESE TERMS. WE RESERVE THE RIGHT TO TAKE EXCLUSIVE CONTROL AND DEFENSE OF ANY CLAIM SUBJECT TO THIS INDEMNIFICATION BY YOU, IN WHICH EVENT YOU WILL COOPERATE FULLY WITH US IN ASSERTING ANY AND ALL AVAILABLE DEFENSES.
GOVERNING LAW, ARBITRATION, NO CLASS ACTIONS
9.1. GOVERNING LAW: The Program and these Terms shall be governed by and construed in accordance with the laws of the State of Texas without giving effect to any conflict of law provisions.

THESE TERMS AND CONDITIONS ("AGREEMENT") REQUIRE BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES AND INCLUDE A CLASS ACTION WAIVER. IN THE EVENT OF A DISPUTE, YOU ARE WAIVING YOUR RIGHT TO SUE IN COURT. THIS AGREEMENT INCLUDES A DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY THAT MAY APPLY TO YOU IN THE EVENT OF A DISPUTE.
